Events Participation Terms and Conditions

Alana Fairchild supports people seeking to become healers or expand their current healing skill sets.

Alana and her team run a combination of free and paid workshops and events (the “Events”) regularly to support the community on their spiritual and soul healing journey, and to experience Alana’s work as a support for that journey, translating her work in a meaningful way for their own personal experience.

This Events Participation Terms and Conditions (the “Agreement”) provides for the conditions of participation in any Event by Alana Fairchild and is a legally binding document between you (the “Participant”) and  Alana Fairchild Pty Ltd ABN 43 613 359 952 (the “Company”, and “Alana Fairchild”) upon the purchase of your ticket.

Terms and Conditions

1. Current Programs

Alana Fairchild Pty Ltd currently runs the following Events:

  • Free and online, and in-person workshops and events
  • Musical performances
  • Evening talks and meditations
  • Dance experiences

Payment Terms

Booking fee

1.1 A non-refundable booking fee may be required when booking an event.
Dates and location

1.2. Events may be delivered online or in person.
1.3. Confirmed dates and locations can be accessed on the website when the Event tickets become available.
1.4. The Company reserves the right to change venues to a venue of similar quality and location where a booked location becomes unavailable for reasons beyond the Company’s control.

Online events

1.5. The Company is not responsible for the reliability of your technology.
1.6. The Company may record online Events and provide the recording; however, not all online Events are recorded.
1.7. It is your responsibility to attend unrecorded “live” online Events.

2. Registration

2.1 By registering for any Event, you agree to all the terms of this Agreement.
2.1 Please contact [email protected] if you have questions about this Agreement or your chosen Event.
2.3 The Event registration fee does NOT include transportation to and from the event venue, any meals, or hotel accommodations unless otherwise stated.
2.4 The Company is not responsible for any losses you suffer for non-refundable travel. Therefore, you are advised to book any non-refundable travel AFTER the Company has confirmed your registration.

3. Cancellation and refunds

Significant planning, preparation and collaboration have been invested in planning Events by Alana Fairchild to ensure an unforgettable and unique experience for you. Therefore, we have a strict refund policy.
3.1 Notification of cancellation of your registration for the Event may be made in writing and sent to [email protected].
3.2 Any refund (if applicable) will be made via the same payment method as the original receipt of funds.
3.3 Where a cancellation is made six (6) months or more after registration, you may be required to provide supporting documentation, such as proof of purchase.
3.4 The notification must include all relevant information regarding the bank account to which a possible agreed refund may be remitted.
3.5 If the notification is received at least five (5) full working days or more before the date of the Event (“Final Cancellation Date”), the Company will provide you with a refund of the fee minus an administration fee of USD50. For retreats or workshops over USD$300, the Administration Fee will be USD75.
3.6 No refunds will be made for cancellations received after the Final Cancellation Date.
3.7 No refunds will be given for your cancellation or non-attendance at any part of an Event. This also applies to multi-day Events (held across more than one day).
3.8 The Administration Fee will apply to approved refunds and is in addition to any non-refundable booking deposit amount.
3.9 All cancellations and refund requests must be in writing by email to  [email protected].
Cancellations in the event of illness will require a medical certificate from a medical professional. 3.10 They will be subject to all fees above. Please include a copy of your medical certificate with your cancellation request.

Cancellation by Alana Fairchild

3.11 In the event of cancellation of an Event by the Company for reasons other than Force Majeure (uncontrollable circumstances as described in Clause 11 below), you will be offered an alternative date for a future Event, or you will be provided with a full refund.

Minimum numbers requirement

3.12 Where the minimum number of participants required for an Event’s viability is not reached, the Company reserves the right to cancel the Event.
3.13 In the event of any cancellation by the Company:
a) you will be offered an alternative date for a future Event, or
b) your deposit and all other monies paid will be refunded in full.

4. Consent to the use of video and photography image

4.1 You understand you may be photographed or filmed during your participation in any event.
4.2 You agree to allow your photograph(s), video, or film likeness, in its original, altered or enhanced state, to be used for any legitimate purpose by the Company.
4.3 Legitimate purpose includes, but is not limited to, marketing purposes such as website, promotional material for public display and distribution, media release, and social media (including but not limited to Facebook, Twitter and Instagram).
4.4 Please advise us if you do not want to be filmed or photographed during the Event.

5. Personal conduct

As an Event Participant, you agree to the following:

5.1 To conduct yourself with personal responsibility during any Event.
5.2 Respect our team and communicate any concerns as soon as practicable.
5.3 Should you engage in inappropriate, illegal or disruptive behaviour, you will be asked to leave the Event at your own cost, and no refund will be available.

Note:

  • Inappropriate, illegal or disruptive behaviour includes but is not limited to bullying, harassment, discrimination, and unlawful, disrespectful or violent or intimidating behaviour.
  • Any person includes but is not limited to the Company’s personnel and employees, the local community, other guests and participants.

6. Disclaimer
You understand and agree:

General

6.1 You have engaged the Company’s services and purchased the Event at your own risk.
6.2 All content, resources and coaching are provided for personal use and information only.
6.3 Alana Fairchild does not offer any representations, warranties, or guarantees, verbally or in writing, regarding your results from the Events.
6.4 The Company cannot guarantee your ability to get results, improve your spiritual practice or development, or otherwise with our mentoring, coaching, tools, ideas, information, or strategies.
6.5 Results depend on various factors, including but not limited to your current health status, commitment, personal ability, and dedication, and in no way dependent on any information or strategy provided to you by the Company.
Medical disclaimer

6.6 Alana Fairchild is a qualified spiritual teacher.
6.7 Alana Fairchild is not a qualified doctor, psychologist, or counsellor.
6.8 Alana Fairchild does not claim to diagnose or heal conditions.
6.9 The information provided in the Events is not intended to, cannot, and should not be expected to be a substitute for advice and treatment from a qualified medical practitioner.
6.10 If you have a physical or mental health condition, please ensure you are well, or your condition is appropriately managed to enable you to attend the Event safely and without risk to yourself or others.
6.11 Any information disclosed in the Events does not replace any treatment plans or protocols for diagnosed physical or mental illnesses or medical conditions.

7.Liability waiver and indemnity

7.1 You agree that the Company is not responsible for any loss, damage, cost, expense or other liability whatsoever incurred by you arising out of:

7.1.1 Injury, accident or death;
7.1.2 Any delay, inconvenience, loss of enjoyment, or frustration, whether physical or mental resulting from, but not limited to, any of the following factors:
a) The act or omission of any party, including Alana Fairchild or its employees.
b) Mechanical breakdown, government actions, weather, or other factors beyond the Company’s control.
c) Your cancellation or change of any travel services; and
d) Your medical or health problems or physical disabilities, stated or otherwise.

Release from liability<strong

7.2 You agree that the Company, its employees and assigns are released from all liability arising from any negligence or fault for your death, disability, personal injury, property damage, property theft, or actions of any kind which may occur to you, including your travel to and from the Event.
8. Assumption of risk

8.1 You are responsible for your own success and accept full and sole responsibility for your decisions, actions and results.
8.2 You understand and agree that the Company does not provide any implied or explicit warranty as to the truth or reliability of any material or information and any information provided to you during the Event and through any media.
8.3 The information presented is for educational and entertainment purposes only, and you assume sole and full responsibility for your own decisions and actions.

9. Force Majeure events (uncontrollable events)
9.1 A Force Majeure is an event outside our control that delays or hinders our ability to perform its obligations under this Agreement.
9.2 A Force Majeure includes but is not limited to fire, flood, earthquake or similar natural disasters, riot, war, terrorism, civil strife, labour disputes or disturbances, industry-wide material or services shortages outside our reasonable control, an outbreak of pandemic disease, governmental regulations, communication, technology or utility failures.
9.3 The Company shall not be deemed in breach of this Agreement for the delay in performing, or failure to perform, any of its obligations under this Agreement if such delay or failure result from Force Majeure events.
9.4 Upon any Force Majeure Event, the Company shall notify the  Participants of the inability to perform or delay in delivering and completing the Event.
9.5 The Company shall propose revisions to the Event schedule for completion of the Services or termination of services and this Agreement where it is determined that performance is not possible because of the duration of effect of the Force Majeure event.
9.6 Where services are terminated because of a Force Majeure Event, Parties agree every effort will be made by both parties to negotiate a financial arrangement to mitigate and share any loss resulting from the Force Majeure event.

10. Dispute Resolution

You understand and agree:

10.1 You will contact the Company immediately with any concerns so that they may be resolved quickly and effectively through friendly consultation.
10.2 In the event of a dispute, you agree to the following Dispute Resolution Procedure:

10.2.1 You must advise the Company in writing of the nature of the dispute, the outcome you seek and what actions you believe will settle the dispute.
10.2.2 You agree to meet in person or via Skype in good faith to seek to resolve the dispute by Agreement and compromise.
10.2.3 If an agreement cannot be reached to resolve the dispute, any party may refer the dispute for mediation to the Law Society of New South Wales (NSW).
10.2.4 Both parties must attend the mediation provided by the Law Society of NSW in good faith to seek to resolve the dispute through mediation.

10.3 Litigation via the court process may only be considered after a genuine attempt at mediation, bought by either party, is unsuccessful.
10.4 Confidentiality is paramount to both parties’ personal and professional reputations and standing in their business and community.
10.5 At no time will any communications or discussions be made public, including but not limited to any social media platforms or websites of either party.
10.6 Any public discussion or comments about either party will be considered defamatory, harmful or otherwise damaging and will be the subject of compensation in any mediation or litigation claim.

11. Governing Law

You understand and agree:

11.1 The Terms and Conditions of this Agreement are governed and construed under the laws of New South Wales, Australia.
11.2 Each party irrevocably and unconditionally submits to the exclusive jurisdiction of New South Wales.

By registering for this Event, YOU, the Participant, affirm you have read and understood this Workshops and Events Participation Agreement and voluntarily agreed to these terms.
